Terms of Trade

Welcome to South Pacific Diamond Tools Limited website.

All prices, minimum/multiple quantities and stock levels are subject to change without notice. All reasonable care is undertaken by South Pacific Diamond Tools Limited to ensure that all information on the site is accurate, complete, reliable, current, and error-free. In the event of any discrepancy, the data held at South Pacific Diamond Tools Limited at the time the order is processed will apply. South Pacific Diamond Tools Limited reserves the right to adjust pricing displayed at invoice level.

Cancellation, Return and Refund Policy

The Customer may only return product to South Pacific Diamond Tools Limited for a change of mind or for incorrect ordering, and receive a credit or refund, on the following conditions:

  1. The Customer must contact South Pacific Diamond Tools Limited in advance and obtain the prior consent of South Pacific Diamond Tools Limited and obtain a goods return number (to be quoted on all returned paperwork);
  2. Return must be made within 30 days of the date of delivery. Product must be returned to South Pacific Diamond Tools Limited in their original packaging, unused and in a saleable condition, to be confirmed by South Pacific Diamond Tools Limited after receipt.
  3. Product must be adequately packed and dispatched freight prepaid, clearly labelled, to the address advised by South Pacific Diamond Tools Limited. Product accepted for return will be credited at invoice value less a handling charge of 10% of the original invoice value. (Minimum charge $35.00)

Delivery

Product ordered from South Pacific Diamond Tools Limited is ex store and South Pacific Diamond Tools Limited will arrange delivery on the customer’s behalf by the most practical means. South Pacific Diamond Tools Limited aim to deliver product relating to an order received on the next working day, usually by courier. The cost of packaging and delivery is added to the invoice price of the customer’s order.

Times and dates for delivery quoted are approximate only and South Pacific Diamond Tools Limited cannot be liable for the consequences of any delay in delivery as delivery is by means of the third party. Delivery of product marked in the catalogue as requiring special handling may (because of their nature) take longer to deliver.

If any delivery is late, the Customer must notify South Pacific Diamond Tools Limited, and South Pacific Diamond Tools Limited will endeavour to ascertain if the product has been delivered or the expected delivery time of the product to the Customer.

Inspection, Transit Delays and Non-delivery

The Customer must inspect all product as soon as reasonably possible after delivery and shall, within 10 days of delivery give written notice to South Pacific Diamond Tools Limited of:

  1. Any defect in a product that is apparent on reasonable examination. In this case South Pacific Diamond Tools Limited shall, at South Pacific Diamond Tools Limited discretion, replace the product or refund the purchase price.
  2. Any shortfall in product delivered. In this case South Pacific Diamond Tools Limited shall, at its discretion, deliver the undelivered product or refund the price of the undelivered product.
  3. Any delivery of product not in accordance with the order. In this case South Pacific Diamond Tools Limited shall, at South Pacific Diamond Tools Ltd discretion, replace the product or refund the purchase price.
  4. Any non-delivery of the product. In this case South Pacific Diamond Tools Limited will seek redress from the third party engaged to transport the product on the customers behalf.
If the Customer fails to give any such notice, the Customer will be deemed to have accepted the relevant order as being delivered in accordance with the Customer’s instructions and to have accepted the product as being free from all apparent defects.
